Could a legal case be made that Biden violated civil rights laws by using race a factor in nominating judges, and therefore, these picks are null and void? Why not?

Unfortunately, no. They were approved by the Senate. Only their own gross misconduct could get them impeached and removed. That is extremely rare.

I think we are talking about two different actions. The Senate approved each nominee on a case by case basis. But if the statistics cited in the article are correct, the actual nominations were based solely on race, well outside of statistical norms, and thus discriminatory. I’m no lawyer, so I’m sure I’m wrong, but why not try?

It doesn't matter. The President has a Constitutional right to nominate whomever he wants for whatever reasons. It is not subject to inferior laws that deal with race discrimination in hiring. The only check is that Senate must approve. Bad decisions are reversed (or not) by superior courts such as the Court of Appeals and the Supreme Court. If they commit a crime or abuse their position, they can be impeached by the House and removed by the Senate. But as I said, this is extremely rare. Finally, if this were possible, don't you think the Ds would have tried it against an R president for nominating too many white judges?

I am only saying that is what they would argue if they thought it would work. It won't for the reasons I said, so they won't try it and it won't work to argue that Biden nominated too many minorities either. It is as I said, a Constitutional right to nominate whomever they want and the only check is the Senate.

As they have been. 99 out 100 times a ridiculous decision will come from a Biden or Obama judge. In the other 1 out of 100, it will be a Republican appointed judge in a blue state where the President gave the D Senators a say in who was nominated. That practice should end if it has not already.

Many years ago back in the 70’s I got into a discussion with a libtard about food stamps. He said you have to feed them because if you don’t you will have to kill them & it’s cheaper to feed them. I responded that like elk in the refuge near Jackson they will reproduce to the limits of their food supply what will happen when we can’t pay for it. I got the same vacate stare you get when you tell them Florida is still there in response to global warming

So it's not okay to check the legal status based on someone's race in the back of the Home Depot parking lot working in the 'under-ground' economy but its okay to create a salamander district based on race? If Trump gets to have a new census that does not include non-citizens from the population how many congressional seats will be put back into states that have little or no illegals? My guess is the Sun Belt and coastal states would lose and the Rust Belt and flyover country would win more seats. Maybe a draw for Ds and Rs but a huge shift in power towards the Heartland, where blue jeans and flannels are still in style and (most) judges are honorable.

I always have the utmost respect for Ann's commentary but she did leave out that Judge Mensah Frimpong graduated from Harvard University with a BA in 1997 and has a JD from Yale Law School in 2001. Not that those degrees prove her colorblindness. In fact they probably show where her liberal mentality comes from. However, it's heartening to know the Judge didn't get her degrees from the Sear Roebuck catalogue, something Ann should've mentioned, in my view.
