EVERYONE has Trump's "First Amendment" claim wrong.
Chaos and confusion about Jack Smith's indictment for Jan 6
Fox News' Trump-Slavering hosts say the First Amendment gives Trump the right to lie and spread disinformation (by the way, great defense guys!), while former AG Bill Barr says “free speech doesn't give you the right to engage in a fraudulent conspiracy."
Both points are irrelevant to Trump’s situation. We don’t even get to the First Amendment because no crime has been alleged. Free speech is a defense, but first there has to be — what is it again? — a crime. And lying isn’t a crime. (See the entire media.). The end. Do not pass go.
It’s true that crimes committed with words aren’t protected by the First Amendment. But, on the other hand, you can’t make a non-crime a crime just by adding the word “conspiracy.” AS I HAVE I ALREADY CLEARLY EXPLAINED, lying isn’t a crime.
If a group of people (or an individual) tell lies to, say, commit a bank robbery or engage in insider trading, the fact that words were used is irrelevant. Why? Because robbery and insider trading are CRIMES. Saying, “but I only used words” is no defense.
But what was the crime here? Answer: Fraud. What was the “fraud”? Answer: Getting people to believe his lie (to “defraud the United States,” “obstruct an official proceeding,” and “against rights”).
Again, lying is not a crime. A bunch of people “conspiring” to lie is not a crime. Lying when you know you are lying and you’re hoping people will believe your lie is not a crime.
Adding the word “conspiracy” can’t miraculously turn something that isn’t a crime into a crime.
I know you hate Trump —you’re late to the party, bud — but please don’t start making up ridiculous legal concepts to accuse him of committing non-existent crimes.
Lying gets you in trouble with God, not the Government.
Unless the government thinks it’s God.
Ann, your legal expertise is always wonderful for clearing the acrid smoke of nonsense and hysteria out of a room.
One naturally wonders, however...in this Dark Age when the law doesn't appear to matter at all when politics are involved...and especially when those hostile to the Left are involved...will it be enough that no law is being broken and no crime committed?
I love America like the stars love the sky, as I know you do.
The Constitution and the Bill Of Rights have guided us so well for centuries.
But I don't think the Framers considered a Government that is so openly hostile to the Constitution and the Rule of Law. When the President is an obviously senile dementia patient and all important decisions are being made by faceless, unaccountable thugs in the shadows...do we still have a chance?
